Is it illegal to sleep in your car in Queensland?

It depends on where the car is parked, not on the sleeping. Queensland has no state-wide offence of sleeping in a vehicle. The rules come from where you stop: the state road network, your council's local laws, and the signs.

On the state road network: rest areas

General and recreational vehicles (including caravans and motorhomes) can stop at a Queensland rest area for up to 20 hours, unless signed otherwise.

Queensland rest areas are not camping sites and are not an accommodation option. The 20-hour stop exists for fatigue management, not for camping. A fatigue stop — pulling over because driving on would be dangerous — is exactly what rest areas are for.

Brisbane (Brisbane City Council)

In Brisbane it is illegal to camp overnight in a vehicle on a road or road-related area, including footpaths, dividing strips, public cycle paths, road shoulders and reserves, under the Health, Safety and Amenity Local Law 2021.

Brisbane City Council lists circumstances where overnight stays in a vehicle are allowed: in designated signed areas, to manage fatigue, for personal safety, in emergencies, and in tourism facilities such as caravan parks and camping grounds.

Gold Coast (City of Gold Coast)

On the Gold Coast it is illegal to camp overnight in a public place, and the City states this includes sleeping, or staying overnight in, a vehicle in a public place.

The City of Gold Coast regulates camping under Local Law No. 16 (Licensing) 2008 and Subordinate Local Law No. 16.6 (Camping Areas) 2008 — covering temporary or semi-permanent accommodation including occupying or sleeping in a tent, caravan or vehicle — and states it is illegal to camp on Gold Coast beaches, roads and parks, with officers patrolling public areas seven days a week.

Sunshine Coast (Sunshine Coast Council)

Sunshine Coast Council does not permit camping on public land, parks and foreshores — including camping in a tent, in a vehicle or on the ground. Overnight camping is allowed only in approved locations, which are signed, and penalties apply for illegal camping.

Moreton Bay (City of Moreton Bay)

Under the City of Moreton Bay's Camping on Public Land Local Law 2023 it is unlawful to camp on public land outside certain circumstances. Camping is defined as staying in an area with the intention of remaining there overnight — including in a vehicle, a caravan, a tent, a boat or with no shelter — and public land includes any land, water or fixture controlled by council, including all council roads, parks, reserves, gazetted foreshores, jetties and canals. Council may declare camping grounds and grant approvals to camp, and the law provides a defence of reasonable excuse.

Logan (Logan City Council)

Logan City Council's local laws changed in 2022 to prohibit camping on council owned or controlled land, including roadsides, footpaths, road reserves, parks and other public places. The council states the changes are not meant to affect people stopping for short periods during the day or when vehicles are broken down.

In practice

Park legally — all normal parking rules apply whether or not you sleep.
Prefer a signed state rest area: the 20-hour rule is explicit and state-wide.
Read the signs. Signage narrows or removes the general rule, and it always wins.
